3/29/10 Update. H. 34 was voted on favorably by the Joint Committee on Homeland Security and Public Safety, and referred to the House Committee on Ways and Means where it awaits further discussion. GOAL will continue to monitor this bill and will notify our members should any action need to be taken.
1/29/2009. The Executive office of Public Safety and Security (notice the removal of “Homeland” from that agency title) has filed a bill to register “Gun Shows”. The bill filed by the state agency would establish a $500 registration fee for any organizer who wishes to hold a gun show. If another new fee were not bad enough, the devil is in the details of the bill language.
The legislation, “An Act Relative to the Regulations of Gun Shows” defines “Gun Show” as: “…an event including participation by one or more dealers for the purpose of selling, renting, leasing or transferring weapons and/or ammunition.”
Two key words appear in this definition. The first is “event” which is undefined and could mean anything from an advertised sale event at a licensed firearm retail store to a banquet where firearms are auctioned. Also, because ammunition is mentioned what about clubs that have a license to sell ammunition and do so at a turkey shoot? The latter may be stretch since the bill includes dealers licensed under section122 and ammo is licensed under 122B, but does anyone trust the state government not to overreach with their history?
The second is “one” as in one or more dealers. According to this bill it only takes the presence of “one” dealer at an “event” to make it a registered ‘Gun Show”.
“Well it was only a matter of time before the state tried to figure out how to add more potential abuse to an already corrupt and unaccountable system. This time, no surprise, they are going after firearm retailers that are already licensed by the state and federal government,” said Jim Wallace, Executive Director of Gun Owners’ Action League. “We can’t trust our state government with the authority it has now regarding our civil rights, why would citizens want to open up more doors for the government to abuse its authority? This is yet another example of the need for REAL REFORM and REAL RESULTS through the Civil Rights and Public Safety Act (www.MassGunLawReform.com).”
AN ACT RELATIVE TO THE REGULATION OF GUN SHOWS
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Chapter 140 of the General Laws, as appearing in the 2006 Official 1 Edition, is hereby amended by inserting after section 122B the following section:- Section 122C. (a) As used in this section, the following terms shall have the following meanings:
“Dealer”, a firearms dealer licensed under section 122 of chapter 140.
“Gun show”, an event including participation by one or more dealers for the purpose of selling, renting, leasing or transferring weapons and/or ammunition.
“Gun show organizer”, any public or private entity, organization or association that is primarily responsible for sponsoring, hosting or facilitating the organization of a gun show.
(b) Not less than 60 days prior to a scheduled gun show, a gun show organizer shall notify the executive director of the criminal history systems board in writing of the date, time, place, and the names and license numbers of dealers expected to attend the gun show and shall submit a registration fee of $500 payable to the criminal history systems board.
(c) A gun show organizer shall provide for access to an electronic communication link to the executive director of the criminal history systems board for the submission of records of all sales, rentals, leases and transfers of firearms by dealers in accordance with section 123 of chapter 140.
(d) A gun show organizer who violates any provision of this section shall be subject to a civil fine of not less than $1,000 nor more than $10,000.
